Acceptance of Terms By accessing or using the ParkView Cam Inc. website, mobile application, or services (“Services”), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, you must not access or use our Services. 2. Eligibility You may only use the Services if you are: At least 13 years old and have provided affirmative confirmation of your age, Between 13–15 years old with verified parental consent, or 16 years or older. Children under the age of 13 are strictly prohibited from using the Services. By using our Services, you represent and warrant that you meet these eligibility requirements. 3. Changes to Terms We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of the Services after changes constitutes your acceptance of the updated Terms. 4. Description of Services ParkView Cam Inc. provides real-time video streams and content related to public parks, recreational areas, and partnered facilities. Our Services may include: Live video streaming Real-time activity indicators Community uploads (via Community Live) Public park information Embedded partner or sponsor content Programmatic advertising Data analytics tools (forthcoming) Some features may be available only to registered users or paid subscribers. 5. User Accounts and Conduct 5.1 Account Creation You may be required to create an account to access certain features. You agree to provide accurate, complete, and current information and to keep it updated. 5.2 Security You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. 5.3 Prohibited Conduct You may not: Access or attempt to access recordings or streams by bypassing access controls Upload or share unlawful, violent, defamatory, obscene, or infringing content Use bots, scrapers, or automated systems without permission Reverse engineer, decompile, or tamper with the platform Impersonate others or misrepresent your affiliation with any person or entity Use the Services to stalk, harass, or surveil We reserve the right to suspend or terminate access for any violations. 6. Intellectual Property All content, trademarks, designs, video feeds, and software are owned by or licensed to ParkView Cam Inc. You are granted a limited, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial purposes. You may not use our logo, branding, or content without express written permission. 7. Video Streams, Recording, and Disclosures 7.1 Live Streaming Our platform primarily provides live video streams. These are not continuously recorded by ParkView Cam Inc. unless explicitly stated. 7.2 Recording Disclosures In locations where recording is active (e.g., for training, safety, or playback purposes), we display appropriate disclosures on the relevant web and app pages. Municipal/Public Facilities: Recording disclosure is included where applicable. Private Facilities: Liability and recording responsibility are contractually delegated to the private operator. ParkView disclaims responsibility for signage, consent, and local compliance for those locations. We only retain recordings (if applicable) for up to 96 hours, and only when technically enabled. 8. Children’s Privacy (COPPA Compliance) ParkView Cam Inc. is committed to complying fully with the Children’s Online Privacy Protection Act (COPPA). Children under 13 are strictly prohibited from creating an account, accessing streams, or using any Services. We do not knowingly collect, use, or disclose personal information from children under 13. If we learn we’ve collected data from a child under 13 without verified parental consent, we will promptly delete it. During sign-up, we include an affirmative age gate, requiring users to confirm they are at least 13 years old. Users aged 13–15 must obtain verified parental consent before accessing Services. Users aged 16 and over may use Services independently. Parents may contact us at info@joinparkview.com to request removal of a child’s information or account. 9. User-Generated Content Users may submit livestreams, comments, or community media via approved features. You retain rights to your content, but grant ParkView Cam Inc. a worldwide, royalty-free license to use, display, and distribute such content in connection with the Services. You are solely responsible for content you upload. We may moderate, remove, or restrict content at our discretion. 10. Accessibility We are committed to making our Services accessible. Programmatic Advertising and Tracking Our Services may include programmatic advertising, including on our website and iOS app. These may utilize cookies, device identifiers, and tracking technologies such as the Identifier for Advertisers (IDFA) on iOS. Third-Party Links and Services Our Services may contain links to third-party websites or services. We are not responsible for their content, terms, or privacy practices. Use at your own risk. 13. Termination We may suspend or terminate your account or access at any time for: Violations of these Terms Illegal or abusive activity Requests by law enforcement or regulators Extended inactivity Upon termination, your right to use the Services immediately ceases. 14. Limitation of Liability To the fullest extent permitted by law, ParkView Cam Inc. and its affiliates shall not be liable for: Indirect, incidental, punitive, or consequential damages Loss of data, revenue, or goodwill Unauthorized access to or use of your information Downtime, interruptions, or technical errors Our liability is limited to the amount you paid (if any) for the Services in the 12 months preceding the event. 15. Indemnification You agree to defend, indemnify, and hold harmless ParkView Cam Inc., its officers, directors, contractors, and affiliates from any claims or liabilities arising out of your: Violation of these Terms Use of or access to the Services Uploaded or transmitted content Breach of any applicable laws or regulations 16. Governing Law These Terms shall be governed by and construed under the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in Pinellas County, Florida. 17. International Users While our Services are accessible worldwide, ParkView Cam Inc. does not target or localize content outside the United States. By using the Services, non-U.S. users acknowledge that: The Services are governed by U.S. law. You consent to data processing in the U.S. You are responsible for compliance with your local laws. 18. Entire Agreement These Terms, along with our Privacy Policy, constitute the entire agreement between you and ParkView Cam Inc. concerning the Services.
